Bằng việc tiếp tục sử dụng dịch vụ trực tuyến/Ứng dụng IZIon24 và/hoặc các ứng dụng khác của IDEAL LIFE, Khách hàng đã xác nhận hiểu rõ, đồng ý và chịu sự ràng buộc bởi toàn bộ các quy định của bản Điều khoản và Điều kiện này (“Điều khoản và Điều kiện”) của IDEAL LIFE và các điều khoản về sử dụng trang web, Ứng dụng IZIon24 và/hoặc các ứng dụng khác của IDEAL LIFE, bao gồm nhưng không giới hạn Chính sách bảo mật và bảo vệ dữ liệu cá nhân của IDEAL LIFE. Vui lòng lưu ý rằng bản Điều khoản và Điều kiện này có thể được sửa đổi, bổ sung tại bất kỳ thời điểm nào tùy thuộc vào quyết định của IDEAL LIFE. IDEAL LIFEkhuyến nghị Khách hàng truy cập thường xuyên để cập nhật thông tin mới và đầy đủ nhất.
By continuing to use the online services/IZIon24 application and/or other applications of IDEAL LIFE, the Customer acknowledges, understands, agrees to, and is bound by all provisions of these Terms and Conditions ("Terms and Conditions") of IDEAL LIFE, as well as the terms governing the use of the website, IZIon24 application, and/or other applications of IDEAL LIFE, including but not limited to the Security and Personal Data Protection Policy of IDEAL LIFE. Please be advised that these Terms and Conditions may be modified or supplemented at any time at the discretion of IDEAL LIFE. IDEAL LIFE strongly recommends that the Customer regularly accesses the platform to stay updated with the most recent and comprehensive information.
1. GIẢI THÍCH TỪ NGỮ
DEFINITION OF TERMS
a. “IDEAL LIFE” hoặc “Chúng tôi”: là Công ty Cổ phần Tư vấn Ideal Life.
“IDEAL LIFE”: means Ideal Life Consultancy Joint Stock Company.
b. “Ứng dụng IZIon24”: là Ứng dụng Bảo hiểm IZIon24 do Công ty Cổ phần Tư vấn Ideal Life sở hữu và phát triển.
“IZIon24 Application”: refers to the IZIon24 Insurance Application, which is owned and developed by Ideal Life Consultancy Joint Stock Company.
c. “Ứng dụng của IDEAL LIFE” hoặc “Ứng dụng”: là Ứng dụng bảo hiểm IZIon24 và/hoặc các ứng dụng, phần mềm khác được sở hữu và phát triển bởi Công ty Cổ phần Tư vấn Ideal Life.
“IDEAL LIFE’s Applications” or “The Application“: refers to the IZIon24 Insurance Application and/or other applications and software owned and developed by Ideal Life Consultancy Joint Stock Company.
d. “Khách hàng”: là cá nhân có thông tin kê khai vào Ứng dụng IZIon24 và/hoặc các ứng dụng, phần mềm khác của IDEAL LIFE tại thời điểm tải, cài đặt và truy cập vào Ứng dụng tại Phương tiện điện tử thích hợp.
“Customer“: refers to an individual who provides information in the IZIon24 Application and/or other applications of IDEAL LIFE at the time of downloading, installing, and accessing the Application on the appropriate electronic media.
e. “Phương tiện điện tử”: là các thiết bị hoạt động dựa trên công nghệ điện, điện tử, kỹ thuật số, từ tính, truyền dẫn không dây, quang học, điện tử hoặc công nghệ tương tự mà bằng việc sử dụng phương tiện này, Khách hàng có thể kết nối đến hệ thống của IZIon24 để truy cập hoặc sử dụng dịch vụ của Ideal Life trên Ứng dụng IZIon24 và/hoặc các ứng dụng khác của IDEAL LIFE. Phương tiện điện tử có thể bao gồm (nhưng không giới hạn) điện thoại di động, điện thoại di động thông minh, máy tính bảng, …
“Electronic media“: refers to devices operating based on electrical, electronic, digital, magnetic, wireless transmission, optical, electronic, or similar technology that enable Customers to connect to IZIon24’s system to access or use Ideal Life’s services on the IZIon24 Application and/or other applications of IDEAL LIFE. Electronic media may include (but are not limited to) mobile phones, smartphones, tablets, and other similar devices.
f. “Chính sách bảo mật và bảo vệ dữ liệu cá nhân” hoặc “Chính sách”: là Chính sách bảo mật và bảo vệ dữ liệu cá nhân của của IDEAL LIFE áp dụng đối với Khách hàng/Chủ thể dữ liệu khi truy cập, sử dụng dịch vụ trực tuyến/Ứng dụng của IDEAL LIFE, cũng như sử dụng bất kỳ sản phẩm hoặc dịch vụ của IDEAL LIFE.
“Security and Personal Data Protection Policy“ or “Policy”: refers to Ideal Life Consultancy’s Security and Personal Data Protection Policy, which applies to Customers when they access or use the IDEAL LIFE’s Applications, as well as when they use any products or services provided by IDEAL LIFE.
2. ĐIỀU KIỆN SỬ DỤNG
CONDITIONS OF USE
Bằng việc truy cập vào Ứng dụng của IDEAL LIFE, Khách hàng đồng ý tuân thủ các điều khoản sử dụng được trình bày dưới đây. Vì vậy, Khách hàng vui lòng đọc kỹ các điều khoản này trước khi sử dụng Ứng dụng của IDEAL LIFE.
By accessing IDEAL LIFE’s Applications, the Customer agrees to comply with the following terms of use. Therefore, please read these terms carefully before using IDEAL LIFE’s Applications.
Chúng tôi xin lưu ý cùng Khách hàng: Điều khoản và Điều kiện này có thể điều chỉnh vào bất kỳ lúc nào. Vì vậy, Khách hàng chủ động truy cập vào mục này để cập nhật và tuân thủ nội dung liên quan.
We would like to inform the Customer that these Terms and Conditions may be revised at any time. Therefore, the Customer is advised to regularly access this section to update themselves and comply with the relevant content.
Trong trường hợp Khách hàng không đồng ý với bất kỳ Điều khoản và Điều kiện nào của Chúng tôi (phiên bản này và các phiên bản cập nhật), vui lòng không tải, cài đặt, sử dụng Ứng dụng hoặc tháo gỡ Ứng dụng khỏi thiết bị di động của bạn (nếu có).
If the Customer does not agree with any of our Terms and Conditions (including this version and any updated versions), please do not download, install, or use the Applications or remove the Applications from your mobile device (if applicable).
3. MIỄN TRỪ TRÁCH NHIỆM
DISCLAIMS RESPONSIBILITY
Trong phạm vi tối đa mà pháp luật cho phép
To the maximum extent permissible by law:
3.1 IDEAL LIFE không có bất kỳ đảm bảo nào rằng Ứng dụng sẽ không bị gián đoạn hoặc không có lỗi vận hành, cũng như không cam kết rằng Ứng dụng và máy chủ kết nối không có phần mềm độc hại ảnh hưởng đến các thiết bị và phần mềm của Khách hàng.
IDEAL LIFE does not provide any guarantee that the Applications will be uninterrupted or error-free, nor does it warrant that the Applications and the connected servers are free from harmful software that may affect the Customer’s devices and software.
3.2 IDEAL LIFE luôn nỗ lực để cập nhật thông tin kịp thời và chính xác vào Ứng dụng, tuy nhiên, sẽ không tránh được một số trường hợp hạn hữu xảy ra lỗi hoặc sai sót.
IDEAL LIFE always strives to update information in a timely and accurate manner on the Applications; however, there may be cases of limited errors or mistakes.
4. ĐĂNG NHẬP VÀ SỬ DỤNG ỨNG DỤNG CỦA IDEAL LIFE
LOG IN AND USE IDEAL LIFE’S APPLICATIONS
Bằng việc truy cập vào Ứng dụng của IDEAL LIFE với số điện thoại và sật khẩu của Khách hàng hoặc bằng mã PIN, Khách hàng xác nhận đồng ý thực hiện các thao tác và cung cấp thông tin trên Ứng dụng. Khách hàng sẽ chịu toàn bộ trách nhiệm đối với các thao tác và thông tin cung cấp này.
By accessing IDEAL LIFE’s Applications with the Customer’s phone number, password, or PIN code, the Customer confirms their agreement to perform operations and provide information on the Applications. The Customer will be fully responsible for these operations and the information provided.
Đồng thời, Khách hàng có trách nhiệm giữ bí mật tuyệt đối Mật khẩu và mã PIN để đăng nhập vào Ứng dụng và cam kết không chuyển mật khẩu hoặc mã PIN hoặc cho mượn/chuyển giao việc sử dụng hoặc truy cập vào Ứng dụng cho bất kỳ bên thứ ba nào. IDEAL LIFE sẽ không chịu trách nhiệm và không có nghĩa vụ đối với bất kỳ thiệt hại nào liên quan đến việc mật khẩu và/hoặc mã PIN của Khách hàng bị sử dụng trái phép bởi bất kỳ bên nào.
Furthermore, the Customer is responsible for keeping the password and PIN code strictly confidential for logging into the Applications and agrees not to disclose, transfer the password or PIN code, or lend/transmit the usage or access to the Applications to any third party. IDEAL LIFE will not be responsible and has no obligation for any damages related to the unauthorized use of the Customer’s password and/or PIN code by any party.
Khách hàng sẽ chịu trách nhiệm đối với mọi thiệt hại và tổn thất, kể cả các tổn thất đối với IDEAL LIFE, phát sinh từ việc để mất các thông tin hoặc sử dụng các thông tin đó, bất kể là khi phát hiện mật khẩu và/hoặc mã PIN của Khách hàng đã bị sử dụng trái phép hoặc có bất kỳ người nào có được các thông tin đó ngoài sự cho phép của Khách hàng, Khách hàng phải thông báo ngay với IDEAL LIFE qua số Hotline 19002809 hoặc Email: hotrobaohiem@izion24.com.vn
The Customer will be responsible for any damages and losses, including losses to IDEAL LIFE, arising from the loss or use of such information, whether the password and/or PIN code are discovered to be used unlawfully or if anyone gains access to that information without the Customer’s permission. The Customer must immediately notify IDEAL LIFE through the hotline number 19002809 or Email: hotrobaohiem@izion24.com.vn
Khách hàng sẽ chịu trách nhiệm đối với mọi thiệt hại và tổn thất, kể cả các tổn thất đối với IDEAL LIFE, phát sinh từ việc để mất các thông tin hoặc sử dụng các thông tin đó, bất kể là có hay không có sự chấp thuận của Khách hàng, cho đến khi IDEAL LIFE được Khách hàng thông báo một cách đầy đủ.
The Customer will be responsible for any damages and losses, including losses to IDEAL LIFE, arising from the loss or use of such information, with or without the Customer’s approval, until IDEAL LIFE is fully notified by the Customer.
Khách hàng cần đảm bảo tính xác thực, đầy đủ và cập nhật thường xuyên về thông tin cung cấp cho IDEAL LIFE liên quan đến tài khoản đăng nhập này.
The Customer must ensure the accuracy, completeness, and regular updating of the information provided to IDEAL LIFE related to this login account.
5. SỞ HỮU TRÍ TUỆ
INTELLECTUAL PROPERTY
Ứng dụng của IDEAL LIFE thuộc sở hữu và được vận hành bởi IDEAL LIFE. Tất cả các thương hiệu, nhãn hiệu dịch vụ, tên thương mại, biểu trưng (logo), và các biểu tượng có trong Ứng dụng được sở hữu và thuộc bản quyền của IDEAL LIFE (“Quyền Sở Hữu Trí Tuệ”). Trừ khi nêu rõ ở trong Điều khoản và điều kiện này và trừ khi được sự cho phép của pháp luật, tất cả các hình thức gây ảnh hưởng đến các Quyền Sở Hữu Trí Tuệ của IDEAL LIFE, bao gồm nhưng không giới hạn ở việc sử dụng, công bố, sao chép, phân phát và khai thác đều được xem là hành vi vi phạm Quyền Sở Hữu Trí Tuệ của IDEAL LIFE và không được phép thực hiện nếu không có sự chấp thuận trước bằng văn bản của IDEAL LIFE.
IDEAL LIFE’s Applications are owned and operated by IDEAL LIFE. All trademarks, service marks, trade names, logos, and symbols in the Applications are owned and copyrighted by IDEAL LIFE (“Intellectual Property Rights”). Unless specifically stated in these Terms and Conditions and unless permitted by law, any form of impact on IDEAL LIFE’s Intellectual Property Rights, including but not limited to use, disclosure, copying, distribution, and exploitation, shall be considered a violation of IDEAL LIFE’s Intellectual Property Rights and is not allowed without prior written consent from IDEAL LIFE.
6. HOẠT ĐỘNG CỦA ỨNG DỤNG
APPLICATION OPERATION
6.1 IDEAL LIFE sẽ sử dụng mọi cố gắng hợp lý để giúp Khách hàng có thể:
IDEAL LIFE will make every reasonable effort to assist the Customer in:
a. Truy cập Ứng dụng vào bất kỳ thời điểm nào; hay
Accessing the Applications at any time; or
b. Sử dụng Ứng dụng liên tục, không gián đoạn, an toàn và không có lỗi
Using the Applications continuously, without interruption, safely, and without errors.
6.2 Khách hàng xác nhận rằng Ứng dụng có thể không phải lúc nào cũng sẵn sàng và có thể bị ngừng kết nối với Ứng dụng này tại bất kỳ thời điểm nào vì bất kỳ lý do gì, bao gồm:
The Customer acknowledges that the Applications may not always be available and may be disconnected from the Applications at any time for various reasons, including:
a. Lỗi do kết nối mạng xảy ra;
Network connection errors;
b. Hệ thống cung cấp dịch vụ không sẵn sàng do bất kỳ lý do gì (gồm cả việc bảo trì);
Unavailability of the service system for any reason (including maintenance);
c. Khách hàng vi phạm bất kỳ điều khoản nào của Điều khoản và Điều kiện này; hay
The Customer’s violation of any terms of these Terms and Conditions; or
d. Chúng tôi quyết định chấm dứt, tạm ngừng hay ngăn chặn việc truy cập vào Ứng dụng của Khách hàng vì bất kỳ lý do gì;
IDEAL LIFE’s decision to terminate, suspend, or block the Customer’s access to the Applications for any reason.
6.3 IDEAL LIFE không đưa ra bất kỳ sự đảm bảo nào về sự vận hành tuyệt đối của Ứng dụng. Hoạt động của Ứng dụng phụ thuộc vào nhiều yếu tố bao gồm nhưng không giới hạn chức năng, năng suất và cấu hình thiết bị của Khách hàng, tốc độ đường truyền và số lượng người truy cập vào hệ thống hỗ trợ Ứng dụng.
IDEAL LIFE does not provide any warranties regarding the absolute operation of the Application. The operation of the Application is contingent upon various factors, including but not limited to the functionality, productivity, and configuration of the Customer’s devices, the speed of the network connection, and the number of users accessing the Application support system.
7. AN NINH THÔNG TIN
INFORMATION SECURITY
IDEAL LIFE rất xem trọng sự an toàn và tính bảo mật của Khách hàng. Chúng tôi sẽ luôn thực hiện các biện pháp an ninh mạng để giảm thiểu các rủi ro tiềm ẩn trong giao dịch điện tử trên phương tiện công cộng.
IDEAL LIFE places great importance on the safety and security of Customers’ information. We will consistently implement network security measures to minimize potential risks in electronic transactions on public platforms.
8. LUẬT ĐIỀU CHỈNH VÀ THẨM QUYỀN XÉT XỬ
GOVERNING LAW AND JURISDICTION
Điều khoản và Điều kiện này sẽ được điều chỉnh bởi pháp luật hiện hành của Việt Nam. Nếu bất kỳ điều khoản hay điều kiện nào trong bản này hay bất kỳ phần nào hoặc khoản mục nào của Điều khoản và Điều kiện này bị tuyên bố là không có hiệu lực hay không thể cưỡng chế thi hành bởi cơ quan nhà nước có thẩm quyền, thì những điều khoản hay điều kiện đó sẽ không làm vô hiệu các điều khoản và điều kiện, các phần hoặc các khoản mục khác của Điều khoản và Điều kiện này sẽ thực hiện theo các quy định khác tại Chính sách bảo mật và bảo vệ dữ liệu cá nhân, quy định sản phẩm và dịch vụ khác của IDEAL LIFE và các quy định của pháp luật có liên quan.
These Terms and Conditions shall be governed by the applicable laws of Vietnam. If any provision or part thereof of these Terms and Conditions is declared invalid or unenforceable by a competent government authority, such invalid or unenforceable provision or part shall not invalidate the remaining provisions, parts, or sections of these Terms and Conditions. They shall be subject to alternative provisions in the Policy on Security and Personal Data Protection, other IDEAL LIFE’s product and service provisions, and relevant laws.
Trong trường hợp có bất kỳ tranh chấp nào mà các bên không giải quyết được bằng thương lượng trên tinh thần hợp tác, bình đẳng, tôn trọng lẫn nhau thì tranh chấp đó sẽ được giải quyết tại Tòa án có thẩm quyền của Việt Nam.
In the event of any dispute that the parties are unable to resolve through negotiation based on cooperation, equality, and mutual respect, such dispute shall be resolved in the competent court of Vietnam.
